MUNICIPAL GOVERNMENT

OFFICE OF THE MUNICIPAL MAYOR



THE CHIEF EXECUTIVE: POWERS, DUTIES, FUNCTIONS

(RA 7160, Title Five, Article 1, Section 444)

For efficient, effective, and economical governance the purpose of which is the general welfare of the municipality and its inhabitants pursuant to section 16 of this code, the Municipal Mayor shall:

1. Exercise general supervision and control over all programs, projects, services and Activities of the municipal government, and in this connection, shall:

Ø Determine the guidelines of municipal policies and be responsible to the Sangguniang bayan for the program of the government;

Ø Direct the formulation of the municipal development plans, with the assistance of the municipal development council and upon approval thereof, by the sangguniang bayan, implemented the same;

Ø At the opening of the regular session of the Sangguniang bayan for every calendar year and, as may be deemed necessary, present the program of government and propose policies and projects for consideration of the Sangguniang bayan as the general welfare of the inhabitants and the needs of the municipal government may require;

Ø Initiate and propose legislative measure to the Sangguniang bayan and, from time to time as the situation may require, provide such information and data needed or requested by the said sangguning in the performance of its legislative function;

Ø Appoint all officials and employees whose salaries and wages are wholly and mainly paid out of the municipal funds and whose appointments are not otherwise provided for in this Code, as well as those he may be authorized by law to appoint;

Ø Upon authorization by the Sangguniang bayan, represent the municipality in all its business transactions, and sign on its behalf all bonds, contracts, and obligations, and such other documents made pursuant to law or ordinance;

Ø Carry out such emergency measures as may be necessary during and in the aftermath of man-made and natural disasters and calamities;

Ø Determine according to law or ordinance, the time, manner and place of payment of salaries or wages of the officials and employees of the municipality;

Ø Allocate and assign office space to municipal and other officials and employees, who, by law or ordinance, are entitled to such space in the municipal hall and other buildings owned or lease by the municipal government;

Ø Ensure that all executive officials and employees of the municipality faithfully discharge their duties and functions as provide by law and this Code, and caused to be instituted administrative or judicial proceedings against any official and employee of the municipality who may have committed an offense in the performance of his official duties;

Ø Examine the books, record and other documents of all offices, officials, agents or employees of the municipality and in aid of his executive powers and authority, require national officials and employees stationed in or assigned to the municipality to make available to him such books, records and other documents in their custody, except those classified by law as confidential;

Ø Furnish coppies of executive orders issued by him to the provincial governor within seventy-two (72) hours after their issuance;

Ø Visit component barangays of the municipality at least once every six (6) months to deepen his understanding of problems and conditions therein, listen and give appropriate counsel to local officials and inhabitants, inform the component barangay officials and inhabitants of general laws and ordinances which especially concern them, and otherwise conduct visit and inspection to the end that the governance of the municipality will improve the quality of life of the inhabitants;

Ø Act on leave applications of officials and employees appointed by him and the commutation of the monetary value of leave credits according to law;

Ø Authorized official trips outside of the municipality of the municipal officials and employees for a period not exceeding thirty (30) days;

Ø Call upon any national official or employee stationed in or assigned to the municipal to advice him on matters affecting the municipality and to make recommendations thereon, or to coordinate in the formulation and implementations of plans, programs and projects, and when appropriate,

OFFICE OF THE VICE MAYOR

POWERS AND DUTIES OF THE VICE MAYOR/SANGGUNIANG BAYAN

OFFICE

(RA 7160, Title Five, Article 2, Section 445)

POWERS AND DUTIES OF THE SANGGUNIANG BAYAN

(RA 7169, Title Five, Article 3, Section 447)

Function: Legislative Supervision

Functional Statement:

1. Enact Resolutions and Ordinances and promote the welfare and growth of the community

2. Appropriate Funds for economic and infra-development

3. Encourage and assist in the implementation of government programs in both government and private sectors

4. Appropriate funds for work programs and budgetary measures of the municipality

THE DIFFERENT DEPARTMENT POSITIONS

MUNICIPAL PLANNING AND DEVELOPMENT OFFICE

(MPDO)

DUTIES OF THE MUNICIPAL PLANNING AND DEVELOPMENT OFFICE

(RA 7160, Title Five, Article six, Section 476 b)

Function: Development Planning

Functional Statement:

1. Formulate integrated economic, social, physical and other development plans and policies for consideration of the local government development council

2. Conduct continuing studies, research and training program necessary to evolve plans and programs for implementation

3. Integrate and coordinate all sectoral plans and studies undertaken by the different functional groups or agencies

4. Monitor and evaluate the implementation of different programs, projects and activities in the LGU concerned in accordance with the approved development plan.

5. Prepare comprehensive plans and other development planning documents for the consideration of the Local Development Council

6. Analyze the income expenditure pattern and formulate and recommend fiscal plans and policies for consideration of the finance committee of the LGU concerned provided under Title V, Book 11 of the Code

7. Promote people participation in development planning within the LGU concerned

8. Exercise supervision and control over the secretariat of the Local Development Council and

9. Exercise such other powers and perform such other duties as may be prescribed by law or ordinance.

MUNICIPAL BUDGET OFFICE

(M.B.O.)

POWERS AND DUTIES OF THE BUDGET OFFICER

(RA 7160, Title Five, Article 5, Section 475)

Function: Budget Management

Functional Statement:

1. Provide technical and staff services to the Chief Executive and other Local Officials on Budget matters

2. Exercise general provisions and control over the Municipal Budget Office

3. Prepare forms and orders, and circulars embodying instructions on budgetary matters and appropriations

4. Prepare the executive and special budget of the municipality

5. Submit budgetary reports to the Provincial and Regional Office of the Budget Management.

6. Review Annual and Supplementary Barangay Budgets

MUNICIPAL ACCOUNTANT’S OFFICE

POWERS AND DUTIES OF THE MUNICIPAL ACCOUNTANT

(RA 7160, Title Five, Article 4, Section 474)

Function: Accounting Services

Functional Statement:

1. Install and maintain an Internal Audit System in the LGU

2. Appraise the SB and other Local Government Officials in the financial condition and operations of the Local Government

3. Certify the availability of budgetary allotment to which expenditures and obligations may be properly changed

4. Review supporting documents attached to vouchers to determine completeness of requirements

5. Prepare and submit financial statements to the Commission of Audit to the Municipal Mayor and SB

6. Account for all issued request for obligations and prepare journals and analysis of obligation

MUNICIPAL ENGINEER’S OFFICE

POWERS AND DUTIES OF THE MUNICIPAL ENGINEER

(RA 7160, Title Five, Article 7, Section 477)

Function: Engineering Services

Functional Statement:

The Office of the Municipal Engineer shall initiate, review, an d recommend changes on policies, plan and programs, techniques, procedures and practices in infrastructures developments and public works in the LGU concerned; advise the Mayor on Engineering works/matters. He will also administer, coordinate, supervise and control the constructions, maintenance improvement and repair of roads, bridges and public works project and provide Engineering Services as the case may be and pattern other works.

MUNICIPAL CIVIL REGISTRAR’S OFFICE

POWERS AND DUTIES OF THE MUNICIPAL CIVIL REGISTRAR

(RA 7160, Title Five, Article 9, Section 479)

Function: Civil Registration

Functional Statement:

The Municipal Civil Registrar shall accept all registrable documents affecting Civil Status of persons, transcribe and enter immediately upon receipt of registrables in the appropriate civil registrar, to furnish the concerned party a copy of the registered document, to send the OCRG thru the NSO a copy of every document, classify and bind all registered certification of documents, administer oath and civil registration purposes, issue marriage license and perform other functions and duties relative to Civil Registration.

Objectives:

1. To accept all registrable documents affecting Civil Status of persons

2. To see to it that all documents are being transformed to and entered immediately in appropriate register books

3. To furnish the concerned party a copy of the documents within the prescribed time.

4. To issue certified documents registered to clients needing it.

5. To classify, bind, index, administer oath on certificate or document and perform other functions as the need arises

6. To put PRN and code to all certificate of births accepted for registration

OFFICE OF THE MUNICIPAL HEALTH OFFICER

(M..H.O.)

POWERS AND DUTIES OF THE MUNICIPAL HEALTH OFFICER

(RA 7160, Title Five, Article 8, Section 478)

Function: Health Services

Functional Statement:

1. Implementation of program and projects on primary health care, maternal and childcare, communicable and non-communicable diseases control service.

2. Purchase of medicines, medical supplies and equipments needed to carry out the different health services.

Objectives:

To protect and promote the right to health of the people and install health consciousness among them (Sec. 15 Art. 1987) Health development which shall endeavor to make essential goals, health and other social services available to all people at affordable costs. There shall be priority to the needs of the sick, elderly, disabled, mother and child. The state shall provide free medical services to the pauper.

MUNICIPAL AGRICULTURIST OFFICE

POWERS AND DUTIES OF THE MUNICIPAL AGRICULTURIST

(RA 7160, Title Five, Article 12, Section 482)

Function: Agricultural Services

Functional Statement:

The Municipal Agriculture Office has a sound and sustainable management of its natural resources which is considered the main source of livelihood for farmers and fishing families. It aims to uplift the quality of life by providing the necessary support services in order to increase productivity.

MUNICIPAL SOCIAL WELFARE AND DEVELOPMENT OFFICE

(M.S.W.D.)

Function: Social Services

Functional Statement:

1. Formulate measures for the approval of the Sanggunian and provide technical assistance and support to the Municipal Mayor as the case maybe in carrying out measures to ensure the delivery of the basic services and provision of adequate facilities relative to social welfare and development services as provided for under section 17 of the local code

2. Develop plans and strategies and approval thereof of the Mayor, implement the same particularly those which have to do with social welfare programs and projects which the Mayor is empowered to implement and which the SB is empowered to approve as provided for under the Local Code

3. Identify the basic needs of the needy, the disadvantaged and impoverished, develop and implement appropriate measures to alleviate their problems and improve their living conditions

4. Provide relief and appropriate crisis intervention for victim of abuse, and exploitation and recommend appropriate measures to deter further abuse and exploitation

5. Assist the Mayor in implementing the barangay level program for the total development and protection of children up to 16 years of age

6. Facilitate the implementation of welfare program for the disabled, elderly and victims of drug addiction, the rehabilitation of prisoners and parolees, prevention of juvenal delinquency and such other activities which would eliminate or minimize the ill-effects of poverty

7. Initiate and support the youth welfare program that will enhance the role of the youth in nation building

8. Coordinate with government agencies and non-governmental agencies/organizations which have their purpose the promotion and the protection of all needy, disadvantaged, underprivileged, impoverished groups of individuals, particularly those identified to be vulnerable and high risk to exploitation, abuse and neglect

9. Be in front of line service delivery, particularly those which have to do with immediate relief during an assistance in the aftermath of man-made natural disaster and natural calamities

10. Recommend to the SB and advice the Mayor as the case maybe on all other matters related to social welfare and development services which will improve the livelihood and living conditions of the inhabitants

11. Exercise such other powers and perform such other duties and functions as maybe prescribed by law or ordinance.

POWERS AND DUTIES OF THE MUNICIPAL WELFARE AND

DEVELOPMENT OFFICER

(RA 7160, Title Five, Article 13, Section 483)

MUNICIPAL TREASURERS OFFICE

POWERS AND DUTIES OF THE MUNICIPAL TREASURER

(RA 7160, Title Five, Article 2, Section 70)

Function: Fiscal Management

Functional Statement:

1. Proper maintenance of tax records ensured correct and up-to-date collection of tax.

2. Utilize available funds for more pressing needs, projects in accordance with the development plan

OFFICE OF THE MUNICIPAL ASSESSOR

POWERS AND DUTIES OF THE MUNICIPAL ASSESSOR

(RA 7160, Title Five, Article 3, Section 472)

Function: Real Property Tax Assessment

Functional Statement:

1. Transfer ownership of real property from tax declaration to another duly supported documents evidence furnishing a copy of the new tax declaration to the Provincial Assessor for his information and record purposes

2. Cancels and/or revises existing tax declaration and notes on the tax declaration being cancelled or revised, by indicating thereon the new declaration number and year of effectivity

3. Issue certificates pertaining to, or certified copies of assessment records of real property tax, and all other records relative to its assessment, upon payment of a service charge fee fixed therefore by ordinance or resolution

4. Administer oath and sworn statements on the valuation of real property and/or tax declaration on filed by the property owner with the Municipal Assessor’s Office for purposes of assessment and taxation

5. Prepare, install and maintain system of tax mapping showing graphically all properties subject to assessment in the municipality and gather all necessary data concerning the same under the direction and supervision of the Provincial Assessor

6. Make frequent physical surveys to check and determine whether all real properties within the municipality are properly declared and listed in the assessment rolls

7. Keep record of all transfer, lease, mortgages or real property rentals incurred and cost of construction of buildings and other improvement on land and income of assessment purposes

8. Cancel all of the assessment in case of several assessment are made for the same property, except the one property made, but if any assessor or his representative shall object to the cancellation made in his name such assessment shall not be canceled but the fact shall be noted on tax declaration and assessment rolls, and property book of record. Preference, however, shall be given to the assessment of the person who has the possession of the property

9. Eliminate from the assessment roll of taxable property such properties which have been destroyed or which is being exempt have been properly included in same , decrease the assessment where property is previously assessed has suffered a permanent loss or value by reason of storm, flood, fire, or other calamity, and increase the assessment where improvement have been made upon the property subsequent to the assessment, subject to the review and approval of the Provincial Assessor

10. To require all transfer of newly acquired real property this municipality the presence of the official receipt of the transfer fees and evidence of just payments of taxes due on property before any transfer of ownership of issuance of new tax declaration will be affected

11. To coordinate and cooperate with the Municipal Treasurer in the collection of real property taxes. The Municipal Assessor shall issue an Order of Payment to the taxpayer which shall be the basis of collection of the said tax for the current year by the Municipal Treasurer concerned

12. Perform such other acts as may be required by the Provincial Assessor in accordance with existing laws, decrees and regulations
